OCI Global (OCI Global or “we”) is strongly committed to protecting the privacy of users (“you” or “your”) visiting oci-global.com or using our related services (“Website” or “Services”). PERSONAL DATA WE PROCESS

OCI Global uses the following Personal Data:

  • Information included in job applications you submit online;
  • Information about any transactions carried out between you and us on or in relation to this Website, including information relating to any purchases you make of our goods or services;

In addition to the purposes stipulated in the relevant sections of this Privacy Notice, and only to the extent this is explicitly allowed by law or such an obligation is imposed on OCI Global by law, we may use your Personal Data for further purposes under the conditions laid down in the GDPR and relevant legislation, including to pursue our legitimate interest in establishing, exercising or defending our legal claims.

If we require to process personal data of individuals related to your company, you may require to obtain their consent before disclosing their personal data to us. In such a case, Please ensure to share OCI Global’s Privacy Notice with them before you share their personal data with us.

CONTACT WITH OCI GLOBAL

We gather and process information when you fill out contact forms to communicate with OCI Global, after having obtained your consent, or you send email communications to OCI Global. This information is used to send you replies to your queries and provide you, to the extent possible, with any help or guidance requested.

Where relevant, in particular if you are a supplier or customer of OCI Global, we may also use this information to perform our obligations and pursue our rights under the contract entered into by you and us, including in the context of any legal proceedings if necessary. Such information is also collected and treated at the stage prior to concluding any contract as a follow-up to you placing an order or making any other relevant inquiry. This may extend to using Personal Data for performing a due diligence on (individuals related to) your company which include its employees, directors, ultimate owners, and other associated individuals to assess the risk presented by (potential or existing) suppliers or customers by performing a screening and sending a questionnaire which includes questions related to individuals including names, addresses, date of birth, email addresses, job titles or shareholding in your company and passport information . Also, Personal Data could be used in the context of internal investigations to establish whether compliance violations have taken place.

JOB APPLICANTS

We collect and use information you provide us with when submitting applications or otherwise when you express your interest to join our team. We use the information you include in your job application for determining your eligibility for the job that you apply for by assessing whether you are the ideal candidate for the position in question.

TRANSACTIONS

We store information about any transaction concluded between you and OCI Global, including invoicing details as required under local legislation. We use this information in order to comply with laws governing the execution of such transactions, including amongst others taxation requirements.

We also process such information to perform our obligations and pursue our rights under the contract entered into by you and OCI Global, including in the context of any legal proceedings if necessary. Such information is also collected and treated at the stage prior to concluding any contract as a follow-up to you placing an order or making any other relevant inquiry. INVESTMENTS IN OCI GLOBAL

We collect and process your Personal Data in the context of any investment you make in OCI Global, whether as a shareholder or bondholder or otherwise. We use this information in order to comply with laws governing the registration or reporting of such investments, including amongst others company law requirements.

We also process such information to perform our obligations and pursue our rights under the contract entered into by you and OCI Global, including in the context of any legal proceedings if necessary. Such information is also collected and treated at the stage prior to placing any investment as a follow-up to you making any relevant inquiry. Failure to provide us with such information may prevent us from smoothly performing our obligations in the context of an existing or future investment relation.

WITH WHOM WE SHARE YOUR PERSONAL DATA

We may share your Personal Data on a strict need-to-know basis, as follows:

  • With OCI Global’s departments, including representatives and employees, as necessary.
  • With affiliates or subsidiaries of OCI Global. Please note that OCI Global has a legitimate interest in transmitting your Personal Data within the group of affiliated companies for internal administrative purposes and to better serve the rest of the purposes stipulated in this Privacy Notice.
  • With third parties that provide services to OCI Global, such as companies that provide services for employee recruitment, IT-related services, or marketing-related services.
  • With a third party in the event of a sale, merger, reorganization, or other transaction involving part or all of OCI Global.
  • With law enforcement agencies if required by law and under the relevant safeguards for the protection of your fundamental rights, in particular where OCI Global reasonably believes unlawful activities, fraud, or bodily injury or death have occurred or the Personal Data may aid an ongoing investigation.

Where OCI Global uses the services of other entities or natural persons outside its organisation to process your Personal Data, this means that such recipients of your Personal Data may act as Processors or (Joint) Controllers under the GDPR. In such cases, OCI Global makes sure that there is a contract with the recipient each time concerned, in particular if they are a Processor, or another legal act outlines their relevant obligations under the GDPR. Nevertheless, OCI Global refuses any responsibility for acts or omissions of third parties acting as Controllers themselves.

TRANSFERS OF PERSONAL DATA OUTSIDE THE EEA

Your Personal Data may be stored in or accessed from countries outside the European Economic Area (“EEA”) to enable us to use the Personal Data in accordance with this Privacy Notice (“Data Transfers”). To this end, we rely on adequacy decisions adopted by the European Commission or other appropriate or suitable safeguards in order to ensure that the level of protection guaranteed by law is not undermined due to such Data Transfers.

HOW LONG WE KEEP YOUR PERSONAL DATA

OCI Global will keep your Personal Data for an appropriate period considering the nature of such information and the purposes for which they are processed. Where relevant, Personal Data pertaining to transactions between you and us shall be stored throughout the lifecycle of the transactions concerned and for as long as is necessary for the pursuit of legal claims or required by local law. OCI Global shall not store your Personal Data longer than is legally permitted or necessary for the purposes outlined in this Privacy Notice.

OCI Global shall attempt in good faith to respond to your request within the time specified by applicable laws. Please note that according to the GDPR, where requests are manifestly unfounded or excessive, in particular because of their repetitive character, OCI Global may either charge a reasonable fee taking into account the administrative costs involved or refuse to act on the request.

SECURITY
OCI Global takes all necessary measures to ensure that processing of your Personal Data meets the requirements of the GDPR and relevant legislation as regards, amongst others, the appropriate level of security in view of the risks entailed in any processing operation. However, we note that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we underline that we shall have no liability for events for which we are not responsible, as provided for in the GDPR.
